Terms of Service

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement made between you and A8E Holdings Ltd. ('Company', 'we', 'us', or 'our'), concerning your access to and use of the paean.ai website as well as any related products and services. By using our products and services, you agree to these Terms of Service.

2. Products and Services

Pæan Ring, Pæan Note, and Pæan Pocket are health and productivity devices. They are not medical devices and should not be used for medical diagnosis. Subscription services include AI-powered features and cloud storage options.

3. Hardware as a Service (HaaS)

Our products are provided under a Hardware as a Service model:

• Ownership: Hardware remains the property of A8E Holdings Ltd. until the completion of 12 consecutive months of active subscription payments, after which ownership transfers to the user.
• Warranty: Hardware is covered by a limited warranty for the duration of your active subscription.
• Cancellation: If you cancel your subscription before 12 months, you must return the hardware or pay a buyout fee.

4. Subscription Terms

Subscriptions are billed annually. You may cancel at any time, but refunds are provided on a pro-rata basis only within the first 30 days. Hardware included with subscriptions remains yours to keep after 12 months of continuous subscription.

5. Intellectual Property

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

6. Governing Law

These Terms shall be governed by and defined following the laws of Canada. A8E Holdings Ltd. and yourself irrevocably consent that the courts of Canada shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
